Many criminal cases rise or fall on whether police followed the Constitution. We aggressively file PC 1538.5 motions to challenge illegal traffic stops, unlawful searches, defective warrants, and improper arrests. When law enforcement cuts corners, we move to suppress evidence — often leading to reduced charges or full dismissal.
Not every case needs to end in a conviction. Where appropriate, we position clients for PC 1000 diversion, Proposition 36, Mental Health Diversion under PC 1001.36, and Veterans Court. These programs can replace incarceration with treatment — and in many cases, lead to a complete dismissal of all charges.
Prosecutors know which defense firms are willing to go to trial — and which will take any plea deal offered. We prepare every case as if it is headed to a jury, giving us real leverage in negotiations. If the case cannot be resolved on fair terms, we are fully prepared to fight for an acquittal in court.

The moments after an arrest are critical. What you say — and who you speak to — can determine whether your case ends in jail time, dismissal, or reduced charges. At Rubin Law, P.C., we move quickly to protect your rights and take control of the situation before the prosecution builds its case.
Law enforcement is trained to gather evidence — not protect you. Anything you say can and will be used against you, even if you believe you are helping your case. Invoke your right to remain silent immediately and ask for an attorney. Say nothing else.
As soon as we are retained, we begin reviewing body-cam footage, police reports, lab results, search warrants, and arrest procedures. We look for errors, inconsistencies, and constitutional violations that can change the outcome of your case.
